I. OVERVIEW

This site is operated by the sole proprietorship Locally Swiss, located at 2016 CortaillodThese general conditions govern the rights and obligations related to the use of the site locally-switzerland.ch, a platform enabling the supply and acquisition of artisanal goods.

Use of the site implies full and complete acceptance of these general conditions.

ARTICLE 1 – SCOPE OF APPLICATION

These T&Cs and current Swiss legislation are binding on all users of the site locally-switzerland.ch.


These General Terms and Conditions form an integral part of the sales contract concluded between a buyer and one seller, in accordance with the definitions of Article 2 of the General Terms and Conditions.

ARTICLE 2 – DEFINITIONS

In these T&Cs, the following terms are defined as follows:

  • User : any natural or legal person consulting or using the site locally-switzerland.ch, buying or selling a product through the platform.
  • Member : any user registered on locally-switzerland.ch with a view to buying and/or selling a product.
  • Buyer : any natural or legal person purchasing a product on locally-switzerland.ch as a member.
  • Seller : any natural or legal person selling a product on locally-switzerland.ch as a member.
  • Offer : publication made by a seller under his own responsibility, offering a product for sale on locally-switzerland.ch.
  • Product : property offered for sale on locally-switzerland.ch by a seller, under his own responsibility.

ARTICLE 3 – OBJECTIVE

Locally-switzerland.ch is a digital platform that allows members to conclude sales contracts between them, independently and under their own responsibility.

 

Contracts concluded on the platform are binding only on the sellers And buyers concerned, in accordance with the provisions of the Swiss Code of Obligations (RS 220).

 

The managers of locally-switzerland.ch are not not stakeholders to sales contracts concluded between members and cannot be held responsible for risks linked to the negotiation, execution or non-execution of these contracts.

II. MEMBERSHIP
ARTICLE 4 – REGISTRATION

To buy or sell on locally-switzerland.ch, users must register as members.

  • Only the natural persons or legal entities having the exercise of civil rights according to the Swiss Civil Code (RS 210) can register.
  • Members must provide accurate and up-to-date information when registering.
  • Registration is free for buyers.
  • Registration of sellers is subject to a fees defined between the parties.

The managers of locally-switzerland.ch reserve the right to:

  • Check the information provided and ask for additional information.
  • Refuse registration without justification.

Use of the platform involves full acceptance of the T&Cs.

ARTICLE 5 – MEMBERSHIP AND TERMINATION

  • Membership begins upon receipt of a confirmation email after registration.
  • Membership is personal and non-transferable.
  • A member may terminate his membership at any time by sending a request to support@localement-suisse.ch.
  • Termination takes effect upon sending a confirmation email by the team of locally-switzerland.ch.

III. OBLIGATIONS OF USERS

ARTICLE 6 – CONFIDENTIALITY OF ACCESS DATA

Members must keep secrets their usernames and passwords and not share them.

 

Locally-switzerland.ch cannot be held responsible for any lack of vigilance resulting in fraudulent access to a member's account.

ARTICLE 7 – TECHNICAL PROHIBITIONS

It is strictly forbidden to use software or mechanisms that disrupt the operation of the site.

 

Users shall not block, modify or copy the content of locally-switzerland.ch.

ARTICLE 8 – PROTECTION OF THIRD PARTY RIGHTS

  • Member posts must not violate the rights of other users or third parties.
  • The words abusive, defamatory or offensive will be deleted.

Article 9 – Prohibition of Advertising

  1. The inscriptions, texts, photographs and/or illustrations that members publish on the site locally-switzerland.ch must not contain any advertising relating to products that are not offered for sale on the platform.
  2. Any external promotion, including links to third-party platforms or announcements of products not available on locally-switzerland.ch, is strictly prohibited.

Article 10 – Maintenance

  1. Due to maintenance operations or technical updates, users and members acknowledge and accept that the site locally-switzerland.ch may be temporarily inaccessible without notice.
  2. This temporary inaccessibility does not give rise to no right to a legal claim from users or members against those responsible for locally-switzerland.ch.
  3. Users and members also acknowledge that use of the site cannot be guaranteed as being uninterrupted, fast and secure at any time.

IV. Obligations of Sellers

Article 11 – Payment of a Monthly Payment

In addition to paying for their registration, sellers pay those responsible for locally-switzerland.ch a monthly payment, the amount of which is defined between the parties.

 

This monthly payment must be paid, at the beginning of each month, into the bank account of the person responsible for locally-switzerland.chInvoices are sent by email and can be sent by post at the seller's request.

 

In case of non-payment on time, a reminder is sent to the sellers. The first reminder is free, subsequent reminders will be charged at CHF 20.00.

 

Failure to use the platform made available by locally-switzerland.ch and/or the failure to conclude a sales contract do not give rise to no discount of the monthly payment nor to no refund of registration.

Article 12 – Sales Authorization

Only products that sellers are skills And authorized for sale may be offered.

 

Sellers must deliver to buyers the possession and full ownership of the product sold, without any charge or hindrance.

 

The managers of locally-switzerland.ch reserve the right, at any time, to withdraw the offer of a product that contravenes this article.

Article 13 – Indications in Accordance with Reality

Sellers undertake to provide information exact And not misleading on the qualities and characteristics of the products offered.

 

Sellers guarantee that the product offered for sale has all qualities and properties mentioned in the offer.

 

They must provide all information relating to the timeframes and procedures for payment, shipping, delivery, return, exchange, refund, warranty for defects and after-sales service of the product.

 

Text, images and other visual elements provided by sellers must not infringe the intellectual property rights of other users, members or third parties.

 

Sellers are authorized to publish photos, texts and illustrations that belong to them or whose use has been duly authorized by the holder of the rights concerned.

V. Relationship Between Seller and Buyer

Article 15 – Exclusion of Liability

As stated in theArticle 3, paragraphs 2 and 3 of these General Terms and Conditions, those responsible for locally-switzerland.ch do not assume no responsibility with regard to the performance of contractual obligations existing between sellers and buyers.

 

The managers of locally-switzerland.ch are not required to check offers published on the platform nor the accuracy of the information provided by the sellers.

 

The managers of locally-switzerland.ch cannot be held responsible for:

  • has. The truthfulness and accuracy of the content of an offer.
  • bThe quality, safety, legality and/or availability of the products offered.
  • c. The ability, authorization and willingness of the members to execute the sales contract.
  • d. Damages resulting from the non-performance or breach of a sales contract concluded between sellers and buyers.
  • e. Damages suffered by users, members and/or third parties following the use of the site locally-switzerland.ch.

The managers of locally-switzerland.ch do not produce any of the products offered for sale on the platform. In the event of damage, their liability according to the Federal Act on Product Liability (RS: 221.112.944) East excluded.

Article 16 – Execution of the Contract

The execution of the sales contract is under the exclusive responsibility buyers and sellers.

 

In accordance with Article 13, paragraph 3 of these General Terms and Conditions, sellers must indicate and respect the conditions of payment, shipping, delivery, return, refund, warranty of defects and after-sales service.

 

In particular, sellers undertake to:

In particular, they recognize that differences in rendering, color or texture may exist due to internet browsing software or the quality of the screens and devices used.

VI. Final Provisions

Article 17 – Data Protection

Concerned about the protection of personal data and the privacy of users and members, the team of locally-switzerland.ch undertakes to act in accordance with the Federal Data Protection Act (SR: 235.1).

 

Personal data of users and members are collected and processed uniquely for the purpose of ensuring the provision of the services offered on the site locally-switzerland.ch, as well as for the management of their invoicing.

 

In addition, users and members agree that those responsible for locally-switzerland.ch use their data for the development and improvement of services.

 

Users and members have a right of access, rectification, opposition and deletion data concerning them. Any request to this effect must be addressed to support@localement-suisse.ch. The identity of the user or member making the request will be verified.

Article 18 – Unilateral Modification of the General Conditions

VI. Final Provisions

Article 19 – Partial Nullity

If certain provisions of these General Terms and Conditions of Sale (GTC) are or become totally or partially null and void, this does not affect the validity of the other provisions, which remain fully applicable.

Article 20 – Jurisdiction and Applicable Law

Any dispute relating to these General Conditions is subject to the exclusive jurisdiction judicial authorities Neuchâteloises.

 

The choice of court concluded after the occurrence of a dispute remains reserved, in accordance with Article 34, paragraph 2, of the Swiss Code of Civil Procedure (RS: 272).

 

Only the Swiss law is applicable, excluding the LDIP (RS: 291). There United Nations Convention on Contracts for the International Sale of Goods (RS: 0.221.211.1) as well as any other interstate convention do not apply.
